Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Tyro mobile application and related services (collectively, the “Service”) operated by Tyro (“we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Acceptance of Terms

By creating an account or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. These Terms constitute a binding agreement between you and Tyro.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Description of Service

Tyro provides a mobile platform that allows users to track and compare visual changes over time through photo-based records. We may add, modify, or remove features at any time without notice. We do not guarantee that the Service will be available at all times or that it will meet all user requirements.

4. User Accounts

a. Registration

You must provide accurate and complete information when creating an account. You agree to update your information promptly if it changes.

b. Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify us immediately at support@tyro.com if you suspect unauthorized use.

5. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law;
• Post or transmit content that infringes any intellectual-property or privacy right of any person;
• Harass, abuse, or harm another person or entity;
• Introduce viruses, malware, or any other malicious code;
• Reverse-engineer, decompile, or attempt to extract the source code of the Service;
• Interfere with or disrupt the security or performance of the Service.

6. Intellectual Property

All content, trademarks, and intellectual property in the Service are owned by Tyro or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You retain ownership of any photos or data you upload; however, you grant us the right to host and display such content solely for the purpose of providing the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

8. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by law, Tyro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to defend, indemnify, and hold harmless Tyro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will cease immediately. All provisions that by their nature should survive termination shall survive.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated versions will be posted within the Service and will indicate the new effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
